The area of family law deals with family-related issues such as divorce, custody actions, child support, post-decree disputes, pre- and post-nuptial agreements, and domestic partnership agreements.

 

 
 

Adoption

Step-parents may adopt their spouses' children if both biological parents agree, or if the non-custodial parent's parental rights have been terminated.  Grandparents may go through a simplified "kinship" adoption process if their grandchildren are available for adoption.

Gays and lesbians can adopt children in Colorado. However, they cannot co-adopt the same child. If a couple wishes to adopt, only one of the couple may legally adopt the child. A same sex partner may adopt his or her partner's child.

However, where a child of a gay or lesbian parent has only one legal parent as a result of alternative reproduction or adoption, a second, same-sex parent may initiate a parentage action and be placed on the child's birth certificate along with the other parent. In such situations, the parent added to the amended birth certificate is a legal parent of the child. That parent will have all of the legal responsibilities associated with parenthood, such as a legal obligation to support the child, as well as all of the legal rights and benefits.
